These terms govern your use of Punchkard, a text-message work-record service for skilled tradespeople. By creating an account or using the service, you agree to these terms.
You must be at least 18 years old and legally able to enter into a contract. Tradespeople using Punchkard to send messages to customers represent that they have obtained those customers' explicit consent at the time of service booking.
You are responsible for everything that happens under your account, including all messages sent to your customers. Keep your login secure. Notify us promptly at support@punchkard.app of unauthorized access.
Punchkard is for sending job-status notifications and review requests to your own customers. Do not use it to:
We may suspend or terminate accounts that violate these rules without refund.
You are responsible for collecting and documenting consent from each customer before adding them to Punchkard. Every message we send includes opt-out instructions. When a customer replies STOP, we honor the opt-out immediately and you are responsible for honoring it across all future communications, not just Punchkard.
Punchkard charges monthly subscription fees plus per-message infrastructure costs. Current pricing is provided to you at the time of account creation. We may change pricing with 30 days' notice.
Cancel anytime by texting STOP CANCEL to your account number, replying CANCEL to a Punchkard email, or clicking Cancel in your account settings. Cancellation takes effect at the end of your current billing cycle. No refunds for partial periods.
You own the records of jobs you punch into Punchkard. We provide export and deletion tools in the app. We retain anonymized, aggregated data for system integrity after deletion.
Punchkard captures GPS coordinates, timestamps, and customer-confirmed delivery events to produce a record of each job. This record is offered as evidence in good faith but is not a substitute for legal proof. Punchkard makes no representation that the records will be admissible in any specific legal proceeding.
The service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted SMS delivery — message delivery depends on carrier and regulatory conditions outside our control.
To the maximum extent permitted by law, Punchkard's total liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
These terms are governed by the laws of the State of Wyoming. Disputes will be resolved in courts located in Wyoming, unless required otherwise by law.
We may update these terms; material changes will be announced 30 days before they take effect. Continued use after changes constitutes acceptance.
